PLEASE READ THESE TERMS AND CONDITIONS before using this SITE and TALKING DATA’s Applications (SITE/APPLICATION).

When you use the SITE/APPLICATION, you signify that you have read, understand and agree with these Terms and Conditions in their entirety in addition to any other law or regulation that applies to the SITE/APPLICATION, Internet and App Stores and you are aware that you are bound by these Conditions and our Policies, so if you do not agree with all, you must not use the SITE or APP. These Terms and Conditions, together with privacy policy and cookies, apply to all visits and use of the SITE/APPLICATION, as well as to the Content, information, recommendations and/or services provided to you on or through the SITE/APPLICATION.

To use this SITE/APPLICATION of TALKING DATA P.C. you must be 18 years old and older. If you are not 18 or older please leave this SITE/APPLICATION immediately. Also users are not permitted to share the content of this SITE/APPLICATION with persons that are not 18 years old or older.

Also you understand and that participation in gambling games may be addictive and can cause loss of money and/or property. In the event that you are addicted in gambling or notice such symptoms please stop using this SITE/APPLICATION and consult appropriate medical doctor.

USE OF SITE/APPLICATION

Illegal, immoral and other inappropriate behavior is prohibited. By entering/accessing and posting through the SITE/APPLICATION you must act according to the applicable Laws and morals. It is restricted to use the SITE/APPLICATION to post, transmit, upload any content that could expose TALKING DATA P.C. or the SITE/APPLICATION users to any kind liability. You should not use, create and post infringing, threatening, harmful, false, abusive, pornographic, misleading, inflammatory, libelous, invasive of privacy, obscene, discriminating, illegal content or any other material that is or could be considered a criminal offence, violation of any party’s rights or which may violate any law gambling or not. You are also prohibited from posting personal data, photos or other material of another person.

RESTRICTIONS OF USE

You may not reproduce, distribute, publish, republish, license, modify, translate, create derivative works from, sell or otherwise exploit the SITE/APPLICATION or its Content (partial), or any information or products obtained or derived therefrom, unless you have the prior, express, written, official permission of TALKING DATA P.C. or it is your own user content that you post in the SITE/APPLICATION. The above notwithstanding, you may display, copy, download onto a single personal computer and/or print part the SITE/APPLICATION or its Content or portions thereof, for your own internal, non-commercial, lawful use, including when you place an order with TALKING DATA P.C. In the event that you download software (including but not limited to screensavers, icons, videos, images, data, files etc) from the SITE/APPLICATION, (collectively, the “Software”) you are aware and agree that are licensed to you by TALKING DATA P.C. and that fact does not transfer ownership or license to the Software to you.

The SITE/APPLICATION is protected under national, regional, and international intellectual property and other laws. Unauthorized use of the SITE/APPLICATION may constitute a violation of such laws.

SITE/APPLICATION CONTENT INTELLECTUAL PROPERTY AND OWNERSHIP

The SITE/APPLICATION is owned and operated by TALKING DATA P.C.. The content of the SITE/APPLICATION, including without limitation all text, images, graphics, designs, logos, icons, interfaces, codes, data, materials and the compilation thereof, as well as the look, selection and arrangement, design and organization of the SITE/APPLICATION, (collectively “Content”), is controlled by TALKING DATA P.C. and constitutes the exclusive intellectual property of TALKING DATA P.C., including without limitation copyrights, trademarks (whether registered or not) and all other pertinent rights exclusively owned and controlled by TALKING DATA P.C., excepting certain portions of the Content that are included herein with the relevant owner’s/licensor’s permission or as permitted under the applicable laws. The use of the SITE/APPLICATION is not intended to and does not grant to any person or entity any intellectual property or other ownership rights in or to the SITE/APPLICATION or its Content. Any breach of the aforementioned clause may be tantamount to a violation of applicable intellectual property rights within the European Union and other applicable laws. TALKING DATA P.C. and any other party authorized on its behalf reserves the right to seek damages to the fullest extent permitted by law against any party committing directly or indirectly this breach.

OTHER ENTITIES

Any reference in the SITE/APPLICATION to any natural or legal persons or images, emblems other than TALKING DATA P.C. or FOOTBALL DATA, whether incorporated or not, including without limitation teams and their emblems, companies, societies, associations, federations, emblems or entities (collectively “Other Entities”), is only made for informational reasons or for reasons of historical reference, from the editor and does not denote or imply any form of partnership, joint venture, parent/subsidiary relationship, association, sponsorship, affiliation, business arrangement, grand of license or other relation of any kind whatsoever between TALKING DATA P.C. and such Other Entity or Entities, unless expressly specified therein.

SERVICES – PRICING

TALKING DATA P.C. SITE/APPLICATION is providing news and information for sports.

TALKING DATA P.C. allows users of the mobile and web applications to be informed about betting percentages and news in sporting events, live sports scores, final results, fixtures, sports statistics etc.

This SITE/APPLICATION is not a betting platform and its content is not, in any case, a prompt or motivation for betting. Especially for the percentages provided (Tipsters Poll) are a combination of predictions by specialists that under specific proceedings give the provided percentages, which have an informational manner. Neither TALKING DATA P.C. nor anyone associated with the SITE/APPLICATION accepts any responsibility whatsoever for any loss that may be sustained as a result of the use (or misuse) of the percentages presented on the SITE/APPLICATION, irrespective of how that loss might be sustained.

The results and other statistics information contained on the SITE/APPLICATION reflect information provided by other independent sources (from third parties).  The content, such as results, statistics must be double checked also from other sources, as errors could occur. TALKING DATA P.C. is not responsible for your use of the results and other information contained on the SITE/APPLICATION.

TALKING DATA P.C. reserves the right to extend, modify or delete services or to make improvements, especially if these serve the technical progress, appear to be necessary or prevent abuse. The changes can alter the appearance, design, navigation or features of the TALKING DATA P.C. Apps. In this case TALKING DATA P.C. does its best to consider the user experience.

The use of the SITE and the Application is free of charge. The Application offers In-App Purchases for full access. By purchasing in the App store you may give personal information. Before doing so, read the terms of use and privacy policy of the store.

Price of the Application may be different from time to time due to alteration of country’s currency rates.

THIRD PARTY

By accepting the use of the SITE/APPLICATION you acknowledge that any contact whatsoever made with third parties after viewing the SITE/APPLICATION, and any outcome which ensues, is absolutely independent of TALKING DATA P.C. and TALKING DATA P.C. is not in any way responsible for any agreement or expectation and other consequence which ensues as a director indirect cause of this contact.

Any claim or dispute which may arise between you and such a third party shall in no way involve TALKING DATA P.C..

COMPLIANCE WITH LAW

Users are advised to comply with applicable legislation in the jurisdiction in which they are domiciled and/or resident and/or present. TALKING DATA P.C. does not accept responsibility for any action taken by any authority against any User in connection with their use of the SITE/APPLICATION.

WAIVER

Any waiver by TALKING DATA P.C. of any breach by any User of any provision of these Terms of Use shall not be considered as a waiver of any subsequent breach of the same or any other provision of these Terms of Use.

DISCLAIMER – WARRANTIES AND REPRESENTATIONS

The SITE/APPLICATION and the content are provided “as is” and without any representations and warranties of any kind. TALKING DATA P.C. disclaims all warranties, including, but not limited to, gambling and non-infringement, to the fullest extent permitted by Law.

By using the SITE/APPLICATION you understand that TALKING DATA P.C. does not represent or warrant that it and its content are complete, accurate, uninterrupted, error free, or that any defects in the SITE/APPLICATION will be corrected or that the SITE/APPLICATION or the Server that makes the SITE/APPLICATION available are free of viruses or other harmful content or components. The downloading or otherwise obtaining content use of the SITE/APPLICATION is in your sole responsibility and any damage occurred in your devices that you use to access the SITE/APPLICATION, is also your own sole responsibility.

To the extent allowed by law, TALKING DATA P.C.. or/and members of our group of companies exclude: all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity, any liability for any direct, indirect or consequential loss or damage (including, without limitation, loss of income/revenue, business, profits/contracts, anticipated savings, data, goodwill or wasted time) incurred by any user in connection with our SITE/APPLICATION or in connection with the use, inability to use, or results of the use of our SITE/APPLICATION, any SITE/APPLICATIONs linked to it and any materials posted on it; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

No warranties or representations are made from TALKING DATA P.C.. and in the fullest extent permitted by applicable Law, regarding the use of the percentages the rest content and in relation with their accuracy, usefulness, correctness or else.

Use of the SITE/APPLICATION is entirely at the Users risk. The SITE/APPLICATION is not a gaming or gambling SITE/APPLICATION. TALKING DATA P.C. does not provide gaming or gambling services, therefore it does not hold or control player funds and it is not involved in any gaming transactions.

Those who choose to access/buy the SITE/APPLICATION do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.

TALKING DATA P.C. is not responsible for any loss or damage, direct or indirect, that the User or a third party might have suffered as a result of using the SITE/APPLICATION, including but not limited to damages caused by a commercial loss, a loss of benefits, a loss on anticipated earnings, winnings or other profit, interruption of business, loss of commercial information, or any other pecuniary and or consecutive loss.

TALKING DATA P.C. is not responsible for winnings made or losses suffered on third party SITE/APPLICATION’s which result from the use of percentages and information displayed on the SITE/APPLICATION.

Without limitation to the above mentioned, no responsibility is being acknowledged or accepted hereunder for, inter alia, the following matters:

I. mistake(s), misprint(s), misinterpretation(s), mishearing(s), misreading(s), mistranslation(s), spelling mistake(s), fault(s) in reading, transaction error(s), technical hazard(s), registration error(s), manifest error(s), Force(s) Majeure and/or any other similar mistake(s)/error(s);

II.  criminal actions;

IV.  advice, in whichever form, provided by TALKING DATA P.C.;

V.   legal actions and/or other remedies;

VI.  loss or damage that Users or third parties might have suffered as a result of their use of the SITE/APPLICATION, its content or that of any link suggested by TALKING DATA P.C.;

VI. criminal use of the SITE/APPLICATION or of its content by any person, of a defect, or omission or of any other factor beyond our control;

VII.  in case of discrepancies in the services, functions and any other feature offered by the SITE/APPLICATION due to viruses or bugs as it relates to all parameters that make up the SITE/APPLICATION, any damage, costs, expenses, losses, or claims brought about by said discrepancies;

VIII.  any act or omission by an internet provider or of any other third party with whom Users may have contracted in order to have access to the SITE/APPLICATION  In case of litigation between the internet provider and Users, TALKING DATA P.C. cannot be a party to the suit, and such suit shall in no way affect these Terms of Use;

and

IX. any claim arising as a result of damages incurred by a User due to the content of any material posted by another User or other third party not authorized by TALKING DATA P.C. on the SITE/APPLICATION.

Please note that some jurisdictions do not permit exclusion or limitations on damages, so some of the above exclusions or limitations may not apply to you.

MISCELLANEOUS

You understand and agree that there might be information in our SITE/APPLICATION that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, packaging and/or product composition. Also, there is a possibility that some products advertised in the SITE/APPLICATION might not always be immediately available.

TALKING DATA P.C. reserves the right to correct any errors, inaccuracies or omissions and/or to modify, remove or update any information in the SITE/APPLICATION without prior notice, in its unfettered discretion.

As a user, if you choose, or you are provided with, an identification code, password or any other piece of information as part of our security, you understand that such information is confidential and not disclosable to any third party. TALKING DATA P.C. may deny access to the SITE/APPLICATION, at any time, if in its opinion, you have failed to comply with any of the provisions of these Terms. User is responsible for ensuring that all persons accessing the SITE/APPLICATION through his connection are aware of these terms, and that they comply with them.

These Terms and Conditions and any other dispute may arise, related to this SITE/APPLICATION, shall be governed by the laws of Greece and the parties hereby submit to the non-exclusive jurisdiction of the Athens Courts. If any portion of these Terms and Conditions become void, it will not affect the validity and enforceability of the remaining provisions.
